Abigail Zwerner, a first-grade teacher, was shot in the hand and chest by a 6-year-old boy at Richneck Elementary School in Newport News, Virginia. A jury found that the shooting could have been prevented if assistant principal Ebony Parker had acted on warning signs.
The seven-member jury, consisting of three men and four women, ruled in favor of Zwerner, awarding her $10 million in damages plus interest. The shooting occurred on January 6, 2023. The jury deliberated for two hours on Wednesday and four hours on Thursday before reaching their decision.
"I remember just three years ago, almost to this date hearing for the first time Abby’s story, and thinking that this could have been prevented," said attorney Diane Toscano.
"So now to hear from a jury of her peers that they agree that this tragedy could have been prevented ... we’re very happy with the outcome for today, and we’re happy that Abby’s story got to be told."
Zwerner was present outside the courthouse with her family but did not speak to the press following the verdict.
