The Allahabad High Court has strongly reprimanded both the victims and the accused in a case involving the SC/ST Act, 1989, exposing what it labeled a severe exploitation of the law and its provisions.
The court dismissed a criminal appeal by 19 accused under Section 14-A(1) of the Act and instructed the victims—a Dalit woman and her two daughters-in-law—to return the ₹4.5 lakh compensation they had received from the State Government. Simultaneously, the court fined the accused ₹5 lakh for their involvement in manipulating the victim and obstructing justice.
On November 4, 2025, counsel for the accused claimed the FIR was lodged using the complainant's thumb impression. This claim was firmly denied by the complainant's counsel, who stated that no FIR was filed by the victim herself.
“Noting that the complainant is a woman belonging to the SC community, the Court apprehended that the applicants might have approached her and exerted undue pressure upon her.”
The bench was led by Justice Shekhar Kumar Yadav, who expressed concern over the manipulation and misuse around this case.
The court’s ruling highlights the critical need to prevent abuse of legal protections intended for vulnerable communities and underlines judicial action against both manipulation and false claims.
